Protocolled on March 25, a bill is being processed in the Senate that aims to address a significant gap in the Brazilian legal system, the false digital identity. O PL 675/2025 prevê a criminalização de perfis falsos em redes sociais, created to gain illicit advantage or cause harm to the honor and image of the victims. "Considering that 51% of Brazilians were victims of some scam last year", according to the 2025 Identity and Fraud Report from Serasa, the measure is a major step forward in combating digital crimes in Brazil, affirms Dr.. Patricia Peck, digital law specialist and CEO of Peck Lawyers. According to the lawyer, Law No. 14.155, 27 May 2021, already foresaw a prison sentence of four to eight years and a fine for frauds committed with data and personal information provided by victims through social networks. However, there was still no specific law criminalizing the use of fake profiles to commit scams. The inclusion of this law represents the addition of mechanisms to cover a legislative gap. So far, we have no legal forecast for those who, through fake accounts, manipulate, obtain illicit advantages or cause harm to the integrity of others, resume Dr. Patricia Peck. Penalties provided for in the Bill The law establishes that fake profiles are illegal when used to manipulate people psychologically, obtain unlawful advantage or harm honor, image, psychological integrity and the property of third parties. If approved, the law will establish a prison sentence of one to five years and a fine for those responsible for false accounts. The punishment can still be increased to imprisonment of up to eight years in the case of a crime committed against a child, teenager, elderly person or person with a disability, if there is exposure of intimate content or the objective is economic extortion. |
