According to the lawyer, Law No. 14.155, May 27, 2021, it already provided for a prison sentence of four to eight years and a fine for frauds committed with data and personal information provided by victims through social networks. However, there was still no specific law criminalizing the use of fake profiles to commit scams. The inclusion of this law represents the addition of mechanisms to cover a legislative gap. Penalties provided for in the Bill The law establishes that fake profiles are illegal when used to manipulate people psychologically, obtain illicit advantage or harm honor, image, psychological integrity and the property of third parties. If approved, the law will establish a prison sentence of one to five years and a fine for those responsible for false accounts. The punishment can still be increased to imprisonment of up to eight years in the case of a crime committed against a child, teenager, elderly person or person with a disability, if there is exposure of intimate content or the goal is economic extortion. |
